Terms of service

Terms of Service

1. About Us

This website is operated by The Gaming Shelf. Throughout these Terms, “we”, “us” and “our” refer to The Gaming Shelf.

These Terms of Service apply when you use our website or purchase products from us. By placing an order, you agree to these Terms together with any other policies referenced on our website.

Nothing in these Terms affects your statutory rights under UK consumer law.

2. Our Products

We aim to describe and photograph our products as accurately as possible.

We sell both new and pre-owned products. Pre-owned products may show reasonable signs of previous use. Where there is significant damage, missing artwork, missing components or another material issue, we will aim to make this clear in the product description.

Product colours and appearance may vary slightly depending on your device or display settings.

All products are subject to availability.

3. Orders

When you place an order through our website, you are making an offer to purchase the products in your order.

We reserve the right to decline or cancel an order where there is a reasonable reason to do so, including where a product is unavailable, there has been an obvious pricing or listing error, payment cannot be authorised, or we reasonably suspect fraud or misuse of our website.

If we cancel an order after payment has been taken, we will refund the amount due to your original payment method.

4. Prices and Payment

Prices are displayed in pounds sterling (GBP).

The price you pay will be the price shown when you place your order, except where there has been an obvious pricing error.

Any applicable delivery charges will be shown before you complete your purchase.

Payment must be successfully authorised before we dispatch your order.

5. Delivery

We currently deliver to addresses within the United Kingdom unless otherwise stated on our website.

Estimated delivery times are provided during checkout or in our Shipping Policy. Delivery estimates are not guarantees, although this does not affect any delivery rights you have under UK consumer law.

Unless otherwise agreed, orders will be delivered without undue delay and within the time required by applicable UK law.

Products remain at our risk until they come into your physical possession, or the possession of someone you have identified to receive them, except where UK law provides otherwise.

Please see our Shipping Policy for further information.

6. Cancellations, Returns and Refunds

Your rights to cancel an online order and return products are explained in our Return and Refund Policy.

Nothing in these Terms or our Return and Refund Policy limits your statutory rights in relation to goods that are faulty, damaged, not as described or otherwise do not conform to your contract with us.

7. Customer Accounts

If you create an account with us, you are responsible for keeping your login details secure and for providing accurate and current information.

Please contact us if you believe your account has been accessed without your permission.

8. Website Use

You may use our website only for lawful purposes.

You must not knowingly introduce viruses, malicious code or other harmful material, attempt to gain unauthorised access to our website or systems, or use the website in a way that interferes with its operation or other customers' use of it.

9. Intellectual Property

Content created by or for The Gaming Shelf, including our branding, website design, text and original graphics, may be protected by intellectual property laws and may not be reproduced or commercially used without permission.

Product names, logos, artwork and other intellectual property belonging to game publishers, console manufacturers, Pokémon or other third parties remain the property of their respective owners.

10. Shopify

Our online store is powered by Shopify, which provides the ecommerce platform that allows us to offer our products to you.

Purchases made through this store are made directly with The Gaming Shelf, not Shopify. Questions relating to your order, products, returns or refunds should therefore be directed to us.

11. Privacy

We process personal information in accordance with our Privacy Policy.

Shopify and other service providers may process information where necessary to provide the services used to operate our store. Further information is available in our Privacy Policy.

12. Our Responsibility

We do not exclude or limit liability where doing so would be unlawful.

Nothing in these Terms excludes or limits your statutory rights, including your rights in relation to goods that must be as described, of satisfactory quality and fit for purpose.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed or for losses resulting from circumstances outside our reasonable control, except where applicable law provides otherwise.

13. Changes to These Terms

We may update these Terms from time to time, for example to reflect changes to our services or applicable law.

The Terms that apply to your purchase will be those applicable when your contract with us is formed, except where a change is required by law.

14. Governing Law

These Terms are governed by the laws of England and Wales.

If you are a consumer resident elsewhere in the United Kingdom, you will also retain any protections and rights provided to you by applicable mandatory law.
